Powerboats include a sailboat under power, even if the sails are still up: the boat on the starboard (right) side has the right of way. overtaking boats a boat overtaken by another boat has the right of way.. Remember, these rules apply to sail and power boats . who gives way? power boats give way to sail boats - remember if a yacht is under engine it is a power boat! remember – port is the left hand side of a boat and starboard is the right hand side . who gives way if i want to overtake?. If the boats are on the same tack, the leeward (downwind) boat is the stand-on vessel, and the windward boat must give way. in sailboat races, there are additional rules about the start line, rounding marks, and so on, but the basic rules above apply when boats meet in open water..
